The NYT Games app requires users to have the most recent iOS update installed on their phones to use the app. No, you can’t use an older version of the app because the moment you open the app it tells you it’s out of date (no longer supported) and sends you back to the App Store. This is not the first app I’ve seen do this. Many apps are now requiring users to, essentially, buy a new phone to continue using them.
